By accessing our website, purchasing a product, submitting an enquiry, accepting a quotation or engaging Fumane for services, you agree to these Terms and Conditions.

5. Pricing

All prices displayed on the website will be stated in South African Rand (ZAR) unless otherwise indicated.

A price change will not ordinarily affect an order that has already been formally accepted by Fumane, except where:

6. Quotations

Quotations issued by Fumane are based on the project scope and information available at the time they are prepared.

Unless otherwise stated on the quotation, quotations may be subject to:

  • Supplier availability
  • Material availability
  • Measurements
  • Final specifications
  • Site conditions
  • Delivery requirements
  • Installation requirements
  • Supplier price changes
  • Client-requested modifications

A quotation does not constitute acceptance of a project by Fumane until the required acceptance procedure and, where applicable, payment requirements have been completed.

The validity period of each quotation will be stated on that quotation.


7. Interior Design Consultations

The Fumane design process may begin with an initial telephone, online or onsite consultation.

An onsite consultation may include:

  • Viewing the client’s space
  • Taking measurements
  • Taking photographs
  • Discussing the client’s requirements
  • Establishing design direction
  • Discussing ideas
  • Reviewing practical requirements
  • Establishing preliminary budget and timeline considerations

The consultation allows Fumane to gather the information required to understand the proposed project.

A consultation alone does not necessarily constitute an agreement for Fumane to complete the entire project.


8. Letter of Agreement and Project Scope

Where a client elects to proceed with a design project, Fumane may issue a Letter of Agreement, proposal, quotation or similar project agreement setting out the scope of work.

The project may range from a limited design or accessories-selection service to extensive interior design, renovation or full-service implementation.

The accepted project agreement may specify:

  • Services to be supplied
  • Deliverables
  • Design fees
  • Deposits
  • Payment milestones
  • Project phases
  • Estimated timelines
  • Procurement responsibilities
  • Installation responsibilities
  • Items excluded from the scope
  • Client responsibilities
  • Special project conditions

Where there is a conflict between these general Terms and Conditions and a signed project-specific agreement, the project-specific agreement will apply to the extent of that conflict, subject to applicable law.


9. Design Phase

Depending on the agreed scope, Fumane’s design services may include:

  • Concept development
  • Space planning
  • Furniture layouts
  • Material selections
  • Colour selections
  • Lighting concepts
  • Wall treatments
  • Window treatments
  • Kitchens
  • Built-in cupboards
  • Custom joinery
  • Furniture selection

  • Technical documentation

Fumane may prepare documentation that provides design direction to architects, builders, contractors, manufacturers and other service providers involved in implementing the project.


10. Concept Presentations and Client Approval

Design concepts will be presented to the client for consideration and feedback.

The client is responsible for carefully reviewing:

  • Designs
  • Layouts
  • Materials
  • Finishes
  • Colours
  • Furniture
  • Fixtures
  • Measurements
  • Specifications
  • Quotations

before providing approval.

Where revisions are included within the agreed service, Fumane may make reasonable modifications following client feedback.

Once a design, product, material or specification has been formally approved, later changes may result in:

  • Additional design fees
  • Supplier charges
  • Restocking charges
  • Manufacturing costs
  • Additional labour
  • Delivery costs
  • Project delays

Any additional charges will be communicated where reasonably possible before the additional work proceeds.


11. Client-Supplied Information and Measurements

The client must provide information that is reasonably accurate and complete.

Where Fumane has not personally verified a measurement, site condition, specification or technical detail, Fumane may rely on information supplied by the client or another professional involved in the project.

Clients should immediately notify Fumane of any errors or changes they become aware of that may affect the project.


12. Project Costing

After a design has been approved, Fumane may proceed with the project costing phase.

Depending on the project, this may include obtaining supplier quotations and costing:

  • Hard finishes
  • Soft finishes
  • Furniture
  • Fittings
  • Fixtures
  • Décor
  • Custom-manufactured items
  • Delivery
  • Installation

A final procurement budget may therefore differ from preliminary estimates provided during the early design stages.


13. Procurement and Sourcing

Where procurement forms part of the agreed service, Fumane may source products and materials on the client’s behalf.

This may include:

  • Obtaining quotations
  • Liaising with suppliers
  • Placing orders
  • Tracking supplier progress
  • Coordinating manufacturing
  • Monitoring deliveries
  • Receiving products
  • Coordinating installation

Fumane works with a range of external manufacturers, suppliers and service providers.

Supplier lead times and product availability may change for reasons outside Fumane’s reasonable control.

Where delays occur, we will make reasonable efforts to keep the client informed and coordinate the project accordingly.


14. Custom and Bespoke Products

Some Fumane products may be:

  • Made to order
  • Manufactured according to specific dimensions
  • Upholstered in a selected fabric
  • Produced in a selected finish
  • Designed specifically for a particular client or property
  • Customised according to an approved design

Custom furniture and bespoke joinery form part of Fumane’s service offering.

Before manufacturing begins, the client may be required to approve relevant dimensions, designs, materials, finishes or specifications.

Once manufacturing or customisation has commenced, changes or cancellations may be subject to additional costs or restrictions, to the extent permitted by applicable consumer law.


15. Orders and Payments

Orders are subject to acceptance by Fumane.

An order may require full payment, a deposit or another payment arrangement depending on the product or service.

The applicable payment requirements will be communicated through:

  • The website checkout;
  • A quotation;
  • An invoice;
  • A Letter of Agreement; or
  • Another written communication from Fumane.

An order may not proceed into sourcing, procurement or manufacturing until the required payment has been received.

Payments must be made using one of the payment methods made available by Fumane.


16. Deposits and Project Payments

Design projects and custom orders may require deposits or milestone payments.

The applicable:

  • Deposit amount
  • Payment schedule
  • Due dates
  • Project milestones
  • Balance payable

will be specified in the relevant quotation, invoice or project agreement.

Failure to make an agreed payment may result in work, manufacturing, procurement, delivery or installation being paused until the outstanding payment has been resolved.


17. Delivery

Delivery availability, charges and lead times may depend on:

  • Product type
  • Product dimensions
  • Delivery address
  • Supplier location
  • Manufacturing lead time
  • Access to the property
  • Installation requirements

Any delivery timeframe supplied by Fumane should be treated as an estimate unless specifically agreed otherwise in writing.

Where products are procured from different suppliers, deliveries may occur separately or in phases.


18. Access for Delivery and Installation

The customer is responsible for ensuring that reasonable access is available for delivery and installation.

Before ordering large furniture or fitted products, customers should consider:

  • Door widths
  • Stairways
  • Lifts
  • Passageways
  • Gate access
  • Ceiling heights
  • Building access restrictions
  • Loading restrictions

Additional costs arising from unusual access conditions may be charged where appropriate and agreed.


19. Inspection of Delivered Products

Customers should inspect products as soon as reasonably possible after delivery or installation.

Any visible damage, incorrect products or obvious defects should be reported to Fumane as soon as reasonably possible together with relevant photographs or other information that may assist us in investigating the issue.

Nothing in these Terms is intended to remove or limit any rights that a consumer may have under applicable South African consumer law. The Consumer Protection Act establishes consumer rights concerning goods and services and provides remedies in applicable circumstances.


20. Returns, Exchanges and Cancellations

Returns, exchanges and cancellations will be considered in accordance with:

  • Applicable South African law;
  • The nature of the product;
  • Whether the item was customised or manufactured to order;
  • The condition of the item;
  • The circumstances of the transaction; and
  • Any separate Returns and Refunds Policy published by Fumane.

Certain electronic transactions and direct-marketing transactions can carry statutory cancellation or cooling-off rights, depending on the circumstances.

Accordingly, nothing in these Terms should be interpreted as excluding a statutory right that cannot legally be excluded.


21. Project Management

Where project management is included in the agreed scope, Fumane may coordinate the implementation of the approved design.

This may involve:

  • Timelines
  • Materials
  • Deliveries
  • Installation
  • Styling
  • Final project handover

The precise extent of Fumane’s project-management responsibility will depend on the services selected by the client and the project agreement.


22. Contractors and Third-Party Suppliers

Projects may require products or work supplied by independent contractors, manufacturers or suppliers.

Where appropriate, Fumane may coordinate with these parties as part of the client’s project.

Fumane will make reasonable efforts to work with suitable service providers; however, third-party availability, manufacturing periods and circumstances outside Fumane’s reasonable control may affect project timelines.

Any warranties supplied directly by a manufacturer or supplier may also be subject to that provider’s applicable terms.


23. Project Timelines

Any project timeline provided during the design or quotation stage may depend on matters including:

  • Client approvals
  • Product availability
  • Supplier lead times
  • Manufacturing periods
  • Contractor availability
  • Site readiness
  • Construction progress
  • Changes to the project
  • Payment of invoices
  • Delivery arrangements

Client-requested changes after approval may affect the completion date.

Fumane will make reasonable efforts to communicate significant changes to projected timelines.


24. Variations and Additional Work

Any work requested outside the agreed project scope may be treated as a variation.

Additional work may require:

  • A revised quotation
  • Additional design fees
  • Additional materials
  • Additional procurement
  • Additional contractor fees
  • Additional manufacturing charges
  • Additional delivery or installation costs

Fumane may require written approval of a variation before proceeding.


25. Site Conditions

Certain problems may only become apparent after work has commenced, including concealed structural issues, electrical or plumbing problems, moisture, uneven surfaces or other existing property conditions.

Where unforeseen site conditions materially affect the project, Fumane will discuss the issue and any necessary change to scope, cost or timeline with the client.


26. Design Intellectual Property

Unless otherwise agreed in writing, all original design work created by Fumane—including concepts, drawings, layouts, renderings, presentations and other creative material—remains protected intellectual property.

A client who has paid all amounts due for the relevant design service may use the completed design for the project for which it was commissioned, subject to the applicable project agreement.

Clients may not reproduce, commercially exploit, resell or use Fumane’s designs for unrelated projects without permission.


27. Website Intellectual Property

Unless otherwise indicated, the content of the Fumane website, including its:

  • Branding
  • Logo
  • Text
  • Layout
  • Graphics
  • Design work
  • Original photographs
  • Illustrations
  • Renderings
  • Website content

may not be copied, reproduced, distributed or commercially exploited without permission from the applicable rights holder.

Some product photographs, product names and other materials may belong to third-party suppliers or manufacturers.


28. Portfolio and Project Photography

Where Fumane wishes to photograph or publish a completed client project for portfolio, website, social-media or marketing purposes, appropriate arrangements should be agreed with the client.

Where privacy or confidentiality requirements apply to a particular project, these should be communicated to Fumane.


29. Third-Party Websites

The Fumane website may contain links to or information obtained from third-party websites, manufacturers, payment providers or suppliers.

These external services operate independently of Fumane and may have their own terms, privacy policies and practices.

Fumane is not responsible for the operation or content of a third-party website merely because a link to it appears on our website.


30. Privacy and Personal Information

33. Events Beyond Our Reasonable Control

Fumane will not be responsible for a failure or delay caused by circumstances reasonably beyond our control, which may include:

  • Supplier interruptions
  • Manufacturing delays
  • Transport disruptions
  • Severe weather
  • Labour disruptions
  • Government restrictions
  • Utility interruptions
  • Natural disasters
  • Other unforeseen events

Where such circumstances materially affect an order or project, Fumane will make reasonable efforts to communicate with the affected client and determine an appropriate way forward.


34. Suspension or Termination of Services

Fumane may suspend work where:

  • Required payments remain overdue;
  • The client prevents reasonable access required to complete the work;
  • Required approvals are repeatedly withheld;
  • Continuing the work would be unlawful or unsafe; or
  • Another material obligation under the project agreement has not been fulfilled.

Any termination of a project will remain subject to applicable law and the provisions of the relevant project-specific agreement.


35. Complaints and Queries

If you have a concern regarding a Fumane product, service or project, please contact us so that we can investigate the matter.
